Terms of Service

The ground rules for using the Digitalspoiler GTM Operating System.

Effective Date: January 1, 2026

The "No Legalese" Summary

  • License: We grant you a revocable, non-exclusive right to use our software for your internal business purposes.
  • AI Output: You own the outputs generated by the AI for your workspace.
  • Responsible Use: Do not use our platform to generate spam, harass individuals, or violate privacy laws.

1. Acceptance of Terms

By registering for or using the Digitalspoiler services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you differ in opinion with any of these terms, you are prohibited from using this Service.

2. Subscription & Billing

  • Fees: Fees are billed in advance on a monthly or annual basis. All fees are non-refundable generally, except as required by law.
  • Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing cycle.
  • Seat Limits: Pricing is based on the number of active users (seats). You agree to pay for all seats provisioned.

3. Use of AI Services

Our Service utilizes generative AI technologies.

  • Accuracy: AI is probabilistic. You acknowledge that outputs ("Generations") may sometimes be inaccurate, offensive, or misleading. You agree to human-review all AI-generated content before sending it to external parties (prospects, customers).
  • Ownership: As between the parties, you own all Input and Output.

4. Acceptable Use Policy

You agree not to mis-use the Service. Prohibited actions include:

  • Reverse engineering the source code.
  • Using the API to train competing machine learning models.
  • Sending unsolicited bulk email (spam) in violation of CAN-SPAM, GDPR, or other regulations.

5. Limitation of Liability

DISCLAIMER: IN NO EVENT SHALL DIGITALSPOILER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

6. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or dashboard notification 30 days prior to them taking effect.
